We represented Versata in a significant intellectual property dispute with one of its major customers, Equifax. Equifax filed a breach of contract lawsuit against Versata in federal court in Atlanta, Georgia, where it is headquartered. Rather than limiting our defense to the contract issues, we expanded our strategy to include a counterclaim for copyright infringement, enabling Versata to seek damages for unjust enrichment. We concentrated on demonstrating the financial benefits Equifax gained by using Versata’s software, and we argued that Equifax’s continued use exposed it to substantial disgorgement risks. After thorough depositions of Equifax’s witnesses and presentations of Versata’s witnesses, the case settled with a multi-million dollar payment and favorable terms for Versata.
