We initiated arbitration before the AAA on behalf of Peak Completions against an accounting and auditing firm, whose identity remains confidential, due to their failure to properly investigate and report on years of financial records that indicated fraudulent activity. This oversight resulted in significant financial losses for Peak. One of the key challenges we faced was navigating past settlements, which the defendant argued should bar Peak from recovering its damages. We devised and executed a strategy that effectively addressed these challenges while preserving Peak’s damage claims. After a rigorous arbitration process, we secured a favorable settlement for Peak.
