We successfully negotiated a complete walkaway for Peak Completions in a breach of contract lawsuit brought by a billion-dollar international raw materials supplier, which was seeking over $12 million in damages. The lawsuit was initiated after the tragic death of Peak’s former president and key witness in an airplane accident, a loss that significantly impacted the company. The supplier attempted to leverage this tragedy to alter the parties’ sales history, leaving Peak at a severe disadvantage without crucial testimony. Despite this, we employed strategic discovery and forensic data analysis to demonstrate that the supplier’s invoices, which formed the basis of its claims, were fraudulent. We also effectively contradicted the testimony of the supplier’s key witnesses to bolster Peak’s defense. On the eve of hearings on Peak’s summary judgment and spoliation motions, the supplier dismissed its claims, resulting in Peak paying nothing.
