We initiated an arbitration before the American Arbitration Association (AAA) on behalf of Peak Completions against an accounting and auditing firm for their failure to properly investigate and report financial records that indicated embezzlement and fraud. This oversight resulted in significant losses for Peak. One of the challenges we encountered was the existence of past settlements, which the defendant argued barred Peak from recovering its damages. We developed and executed a strategy that effectively addressed these issues while preserving Peak’s right to claim damages. After a rigorous arbitration process, we achieved a favorable settlement for Peak. The details of the arbitration and its outcome remain confidential.
